1. Acceptance of Terms 

By accessing, viewing, or using the services of DMA Graphix, you agree to comply with and be bound by these Terms and Conditions. If you do not agree, you may not use our services.

2. Scope of Services DMA Graphix provides graphic design, artwork customization, and related creative services. All deliverables are finalized based on the criteria outlines and agreed upon through mutual written agreements before project launch.

3. Consultation and Project Agreements

• All consultations and services (i.e., quotes, adjustments) must be officially booked through the DMA Graphix platform.

• DMA Graphix is only responsible for design agreements and commitments made in writing during an official consultation or within your account dashboard, subject to strict accuracy.

• Modifications or adjustments to the visual concepts or deliverables must be documented and agreed to by DMA Graphix.

4. Payments and Deposits

• Pricing and payment terms will be set out clearly in individual project outlines and estimates.

• A deposit is required to start any project, with the remaining balance due upon project completion.

• Failure to make payments as agreed may result in project delays or termination.

5. Revisions and Approvals

• Clients are entitled to a specified number of revisions as agreed upon in writing during the consultation.

• Additional revisions beyond the agreed amount may incur separate charges.

• Once the client provides final approval on a design, DMA Graphix is not responsible for any errors, typos, or design flaws noticed after the fact.

6. Intellectual Property & Customer Warranties

• Client Content: The client represents and warrants that all text, graphics, photos, designs, trademarks, or other artwork provided to DMA Graphix for inclusion in the project are owned by the client, or that the client has explicit permission from the rightful owner to use them.

• IP Infringement Indemnity: The client agrees to indemnify, defend, and hold harmless DMA Graphix from any and all claims, suits, liabilities, or expenses (including legal fees) arising from any claim that the materials provided by the client infringe upon the intellectual property rights of any third party.

• DMA Graphix Ownership: DMA Graphix retains ownership of all preliminary concepts, working drafts, and source files. Upon final payment in full, ownership of the final approved design asset transfers to the client.

• Portfolio Rights: DMA Graphix retains the right to display the final artwork in portfolios, websites, and social media for promotional purposes, unless otherwise agreed in writing.

• ​Use of Artificial Intelligence (AI) Tools: DMA Graphix may utilize artificial intelligence tools and machine-learning software for inspiration, brainstorming, asset generation, or template creation during the design process. Because the legal landscape surrounding AI-generated art is evolving, DMA Graphix cannot guarantee that AI-assisted elements are entirely unique or eligible for exclusive copyright registration. The client accepts the final deliverables with this understanding.

7. Delivery and Formats

• DMA Graphix delivers completed designs via digital formats agreed upon in the project outline.

• File delivery timelines are estimates and are contingent upon timely client feedback and approvals.

8. Cancellation and Refunds

• Clients may cancel a project before work begins, subject to a partial or full refund depending on the situation. Deposits are generally non-refundable.

• Under defined situations, refunds will be issued solely at DMA Graphix's discretion based on the amount of work completed.

9. Liability and Disclaimer

• DMA Graphix is not responsible for any damages, losses, or legal actions resulting from the use or misuse of standard layouts or customized artwork.

• We cannot guarantee specific display outcomes across different devices.

• Liability Cap: In no event shall DMA Graphix's total liability to the client for all damages, losses, and causes of action exceed the total amount paid by the client to DMA Graphix for the specific project in question.

10. Changes to Terms 

DMA Graphix retains the right to update these Terms and Conditions at any time. Continued use of our services constitutes acceptance of any modifications.
